OFFICE OF THE CITY CLERK SEPTEMBER 16, 2019 CERTIFICATION OF SUFFICIENCY OF AN INITIATIVE PETITION TO ALLOW OPERATION OF CANNABIS BUSINESSES THAT PREVIOUSLY OPERATED ILLEGALLY, IN VIOLATION OF THE PASADENA MUNICIPAL CODE BACKGROUND Office of the City Clerk On March 6, 2019, proponents for an Initiative Petition To Allow Operation Of Cannabis Businesses That Previously Operated Illegally, In Violation Of The Pasadena Municipal Code submitted a notice of intention to circulate a petition. On July 31, 2019, the City Clerks Office received the filing of the initiative petition, containing approximately 12,900 signatures

On August 1, 2019, following City Clerks prima facie review, the petition was forwarded to the Los Angeles County Registrar-Recorder/County Clerk for signature verification 2 BACKGROUND Office of the City Clerk Sufficiency of Initiative Petition: > Proponents filed 12,930 signatures in support of initiative petition > There are 85,416 registered voters in the City of Pasadena (based on County Registrars February 10, 2019 official report to the Secretary of State) > Therefore, 8,542 verified signatures needed to meet the 10% requirement > LA County completed a full review of the 12,930 signatures and were able to verify 9,138 as signatures of

registered voters of the City of Pasadena > Meets the 10% requirement > Initiative Petition now deemed sufficient 3 AVAILABLE OPTIONS Office of the City Clerk Options available to the City Council: Adopt the proposed initiative ordinance, without alteration > Conduct First and Second Reading > Ordinance becomes effective 30 days after publication of the ordinance Submit initiative measure to voters, without alteration > EC 1405: The election for a municipal initiative that

qualifies.shall be held at the jurisdiction's next regular election." > The next regular municipal election will occur on March 3, 2020 Order a report on the impacts of the proposed initiative 4 > The report shall be presented no later than 30 days RECOMMENDATION Office of the City Clerk > Find that the proposed actions are exempt from review pursuant to the California Environmental Quality Act (CEQA) and in accordance with State CEQA Guidelines Section 15061(b)(3) (General Rule); > Receive and accept the certification of the sufficiency of an initiative petition to allow operation of cannabis businesses that previously operated illegally, in violation of the

Pasadena Municipal Code, as confirmed by the examination and verification of signatures by the Los Angeles County Registrar-Recorder/County Clerk's Office; and > Pursuant to California Elections Code (EC) Section 9215, the City Council shall do one of the following: (a) Adopt the ordinance, without alteration, at the regular meeting at which the certification of the petition is presented, or within 10 days after it is presented. (b) Submit the ordinance, without alteration, to the voters. (c) Direct City staff to prepare a report on the impacts of the proposed initiative measure within 30 days of the certification of the petition.
